What is a Right to Build?
A Right to Build, or RTB, is an authenticated, transferable authorization to physically realize a specific artwork according to the artist’s sealed record.
The distinction
An RTB is not a fabricated sculpture, a fabrication contract, a deposit, or a pre-order. Its purchase price covers the authenticated realization right and its registry transfer.
The owner may hold or transfer that right without building the work. If the owner later chooses to realize it, production is a separate undertaking.
What ownership does not include
Unless a separate written agreement expressly says otherwise, the RTB price does not include materials, engineering, fabrication, finishing, transport, insurance, storage, site work, permits, installation, maintenance, artist oversight, conservation services, or project management.
Those services are separately selected, contracted, scheduled, and paid for by the owner when the owner decides to realize the artwork. Futuro Spatial does not become the producer, construction manager, fabricator, engineer, installer, insurer, or guarantor of the physical work merely because an RTB is acquired through the platform.
